{"id":1624,"date":"2014-03-14T08:46:27","date_gmt":"2014-03-14T08:46:27","guid":{"rendered":"http:\/\/greenalt-live.w3i.app\/en\/georgian-ministry-of-energy-orders-use-of-force-against-local-protesters-who-fear-landslides-from-hydro-construction\/"},"modified":"2021-05-23T06:42:18","modified_gmt":"2021-05-23T06:42:18","slug":"georgian-ministry-of-energy-orders-use-of-force-against-local-protesters-who-fear-landslides-from-hydro-construction","status":"publish","type":"post","link":"https:\/\/greenalt-live.w3i.app\/en\/georgian-ministry-of-energy-orders-use-of-force-against-local-protesters-who-fear-landslides-from-hydro-construction\/","title":{"rendered":"Georgian Ministry of Energy orders use of force against local protesters who fear landslides from hydro construction"},"content":{"rendered":"\n<p>Last weekend, the Georgian Ministry of Energy and Natural Resources again left no doubt about where its main interests lie: enforcing the massive exploitation of Georgia\u2019s hydropower potential despite and against people\u2019s concerns and if necessary by use of force.<br><br>On Saturday, March 8, about 500 villagers staging a road block in the&nbsp;<strong><a rel=\"noreferrer noopener\" href=\"http:\/\/news.bbc.co.uk\/2\/hi\/europe\/country_profiles\/3520322.stm\" target=\"_blank\">Adjara region<\/a><\/strong>&nbsp;were violently dispersed by an equal number of policemen and special forces. Deputy Minister of Energy, Ilia Eloshvili, stood by after ordering the intervention even though the reasons for his presence at the scene are unclear.<\/p>\n\n\n\n<p>The incident has been recorded on video and<strong>&nbsp;<a href=\"http:\/\/www.netgazeti.ge\/GE\/105\/News\/28978\/\" target=\"_blank\" rel=\"noreferrer noopener\">reported in Georgian media<\/a>.<\/strong> A representative from the Georgian Young Lawyers Association (GYLA), Gia Kartsivadze, said in an&nbsp;<a href=\"http:\/\/www.netgazeti.ge\/GE\/105\/News\/28981\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>interview with netgazeti.ge<\/strong><\/a>:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-style-large\"><p>\u201cBased on what I have seen in videos filmed by the people there I can say that the police used violence against the protesters. GYLA is planning to provide legal assistance to the people.\u201d (own translation)<\/p><\/blockquote>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-embed-handler\"><div class=\"wp-block-embed__wrapper\">\n<div class=\"arve\" data-mode=\"normal\" data-oembed=\"1\" data-provider=\"youtube\" id=\"arve-youtube-qdpwj_7acbg6a3451336e463500665219\" style=\"max-width:900px;\" itemscope itemtype=\"http:\/\/schema.org\/VideoObject\">\n<span class=\"arve-inner\">\n<span class=\"arve-embed arve-embed--has-aspect-ratio\">\n<span class=\"arve-ar\" style=\"padding-top:75.000000%\"><\/span>\n<meta itemprop=\"embedURL\" content=\"https:\/\/www.youtube-nocookie.com\/embed\/QdPWj_7ACbg?feature=oembed&amp;iv_load_policy=3&amp;modestbranding=1&amp;rel=0&amp;autohide=1&amp;playsinline=0&amp;autoplay=0\">\n<iframe loading=\"lazy\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen class=\"arve-iframe fitvidsignore\" data-arve=\"arve-youtube-qdpwj_7acbg6a3451336e463500665219\" data-src-no-ap=\"https:\/\/www.youtube-nocookie.com\/embed\/QdPWj_7ACbg?feature=oembed&amp;iv_load_policy=3&amp;modestbranding=1&amp;rel=0&amp;autohide=1&amp;playsinline=0&amp;autoplay=0\" frameborder=\"0\" height=\"675\" sandbox=\"allow-scripts allow-same-origin allow-presentation allow-popups allow-popups-to-escape-sandbox\" scrolling=\"no\" src=\"https:\/\/www.youtube-nocookie.com\/embed\/QdPWj_7ACbg?feature=oembed&#038;iv_load_policy=3&#038;modestbranding=1&#038;rel=0&#038;autohide=1&#038;playsinline=0&#038;autoplay=0\" width=\"900\"><\/iframe>\n\n<\/span>\n\n<\/span>\n\n<\/div>\n\n<\/div><\/figure>\n\n\n\n<p><em>The currently available video footage only depicts the scene after the police has taken control of the road.<\/em><\/p>\n\n\n\n<p>The villagers blocked the road to prevent the construction of a tunnel for the 185 MW Shuakhevi hydropower plant (HPP) which the European Bank for Reconstruction and Development is considering to finance with<span class=\"has-inline-color has-vivid-red-color\">&nbsp;<\/span><strong><a rel=\"noreferrer noopener\" href=\"http:\/\/www.ebrd.com\/pages\/project\/psd\/2014\/45335.shtml\" target=\"_blank\"><span class=\"has-inline-color has-vivid-red-color\">a loan of up to USD 86.5 million<\/span><\/a><\/strong> (EUR 63.7 million). The tunnel, to be drilled under the&nbsp;<strong><a rel=\"noreferrer noopener\" href=\"https:\/\/goo.gl\/maps\/I6vLc\" target=\"_blank\">village Ghurta,<\/a><\/strong> is one of three planned diversion tunnels as part of the project.<\/p>\n\n\n\n<p>The locals say the territories of their villages are characterised by landslides and worry that the construction of a derivation tunnel and a reservoir may activate them. People still remember when in 1971 the worst of the landslides cost 22 people\u2019s lives. The project company, Adjaristsqali Georgia LLC, denies these risks yet at the same time refuses to sign warranty contracts to offer compensation should the constructions cause damages.<\/p>\n\n\n\n<p>The exact role of the Ministry of Energy in all this and the reason for Eloshvili\u2019s presence is so far unclear. The construction permit for the plant was issued by the Ministry of Economy and partly based on expertise of the Ministry of Environment. The Ministry of Energy only initiated the project and signed a <strong>\u201cBuild, Operate and Own\u201d<\/strong> agreement with Adjaristsqali (censored version available&nbsp;<strong><a href=\"http:\/\/www.greenalt-live.w3i.app\/webmill\/data\/file\/BOO_Agreement_GOG_and_AGL_CEI.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">here<\/a><\/strong>) which should have ended its involvement.<\/p>\n\n\n\n<h3><strong>Risk assessment<\/strong><\/h3>\n\n\n\n<p>In order to decide between these contradicting claims a proper investigation into the landslide risks is needed, especially in the area where said tunnel will be constructed. In principle, the project\u2019s environmental impact assessment (EIA) from September 2013 could offer this, but the study was by far not detailed enough. The&nbsp;<strong><a href=\"http:\/\/www.ebrd.com\/english\/pages\/project\/eia\/45335esiag.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Georgian version&nbsp;<\/a><\/strong>(pdf) describes this in chapter 6.9.4:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-style-large\"><p><em>\u201c[T]he geomorphologic and landslide hazard maps have been prepared from aerial photo interpretation supplemented by data from the ground and are not the result of detailed field mapping with full ground coverage. Both maps should therefore be used to&nbsp;<strong>indicate the general condition of the land surface over large areas.<\/strong><\/em> <em><strong>Detailed ground investigations may be necessary for assessment of small areas and specific sites.<\/strong>\u201d<\/em>&nbsp;(emphasis added, our translation)<\/p><\/blockquote>\n\n\n\n<p>The ESIA report does not contain detailed geological surveys on the ground and for this reason alone cannot rule out negative impacts such as landslides. (Interestingly, this information is not to be found in the English version of the EIA report (available on the&nbsp;<strong><a href=\"http:\/\/www.ebrd.com\/english\/pages\/project\/eia\/45335esia.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">EBRD\u2019s website<\/a><\/strong>&nbsp;(pdf)) which lacks the entire chapter 6.9.)<\/p>\n\n\n\n<p>The report acknowledges this on page 392 (again, only in the Georgian, not the English version):<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-style-large\"><p>\u201c[\u2026] unexpected ground conditions may be encountered during the course of the construction works\u201d.<\/p><\/blockquote>\n\n\n\n<p>The lack of geological survey data is especially true for the area near Ghurta, where the Skhalta Transfer Tunnel is planned to be constructed. It is covered in chapter 5.3.6.5 of the EIA report (equally only in the Georgian version):<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-style-large\"><p>\u201cSkhalta Transfer Tunnel \u2013 No mapping or intrusive work has been undertaken along the Skhalta to Didachara transfer tunnel.\u201d<\/p><\/blockquote>\n\n\n\n<p>The environmental impact assessment therefore clearly states that&nbsp;<strong>the project promoter has no knowledge whatsoever of the geological conditions around the village of Ghurta<\/strong>&nbsp;and the damage that the Shuakhevi HPP project may cause there.<\/p>\n\n\n\n<h3><strong>Improved standards with the EBRD?<\/strong><\/h3>\n\n\n\n<p>The project company Adjaristsqali Georgia LLC and the was very well aware of the EIA\u2019s shortcomings. We had raised them in&nbsp;<strong><a href=\"http:\/\/greenalt-live.w3i.app\/app\/uploads\/2013\/07\/Shuakhevi_HPP_on_Adjaristskali_GA_comments.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">our comments to the report<\/a><\/strong>&nbsp;(pdf) [ka].
